The Garden Room – Live Session Terms & Conditions

By booking and participating in a live recording session at The Garden Room, you (“Artist” or “Purchaser”) agree to the following terms and conditions:

1. Services Provided

The Garden Room provides live video recording sessions that include:

Two-camera video capture

Professional audio mixing and mastering

Delivery of final edited video(s) optimized for distribution and social media

Sessions are offered at a rate of $90 per song, unless otherwise agreed in writing.

2. Ownership & Source Materials

To keep things simple and consistent across sessions:

The Garden Room maintains ownership of all original session materials created during recording, including raw video footage, audio recordings, and project files.

These materials are part of The Garden Room’s internal production process and are not included in the standard session rate.

This structure allows us to deliver polished, ready-to-use content while maintaining long-term organization and quality control across sessions.

3. License Granted to Artist (Final Deliverables)

Upon full payment, the Artist is granted a non-exclusive, perpetual, royalty-free license to use the final delivered video(s) and audio for:

Social media platforms

Streaming platforms

Artist websites

Press, marketing, and promotional use

The Artist may distribute, repost, and monetize the final delivered content without additional approval.

This license applies only to the final edited deliverables, not to raw or project files.

4. Raw Files & Project Files

Raw footage, audio files, and project files are not included in the session price.

Raw files may be purchased separately at an agreed-upon rate, subject to availability.

The Garden Room is under no obligation to release raw files unless a separate agreement is made in writing.

5. Studio & Promotional Use

The Garden Room reserves the right to:

Use short clips, stills, or excerpts from the session for promotional purposes (including website, social media, and marketing), unless the Artist requests otherwise in writing prior to the session.

Artists will be credited where reasonable and appropriate.

6. No Transfer of Ownership

Nothing in this agreement shall be interpreted as a transfer of ownership or copyright to the Artist beyond the usage license described above.

7. Payment & Delivery

Full payment is required prior to or at the time of the session.

Delivery timelines may vary depending on workload, but reasonable turnaround times will be communicated.

8. Creative Direction & Final Edits

The Garden Room retains final discretion over:

Camera angles

Editing style

Color grading

Audio balance

Minor revision requests may be considered but are not guaranteed unless previously agreed.

9. Limitation of Liability

The Garden Room is not responsible for:

Performance quality

Missed notes, timing issues, or artistic choices

Technical issues beyond reasonable control

In the event of catastrophic data loss, liability is limited to a refund of the session fee.

10. Acceptance

By booking a session, the Artist confirms that they have read, understood, and agreed to these terms.
